IP & BRAND PROTECTION POLICY
This IP & Brand Protection Policy (“Policy”) governs all intellectual property (IP), trademarks, copyrights, and user-generated content (“UGC”) on the Profylee platform (“Platform”, “Company”).
All users—including individuals, employers, freelancers, agencies and corporate accounts—must comply with this Policy.
1. PURPOSE AND SCOPE
This Policy applies to:
- Copyrighted materials
- Trademark usage
- Creative works (design, code, writing, visuals)
- Portfolio content
- Project submissions
- Job postings and descriptions
- User-generated content (UGC)
Profylee complies with DMCA (17 U.S.C. § 512), WIPO standards, EU Copyright Directives, and global IP regulations.
2. PROFYLEE’S OWN INTELLECTUAL PROPERTY
The following are owned exclusively by Profylee:
- Profylee brand, logo and brand assets
- UI/UX design elements
- Website and app codebase
- Database structure
- Algorithms and matching systems
- Module names (Flow, Pool, Works, Showcase, Publish, Insight, etc.)
- Platform documentation and content
Users may not:
- Copy, duplicate, alter, or misuse Profylee trademarks
- Build apps, bots, scrapers with Profylee identity
- Misrepresent affiliation with Profylee
3. USER-GENERATED CONTENT (UGC)
Users retain ownership of their uploaded content.
However, by uploading content, users grant Profylee a:
revocable, non-exclusive, royalty-free, worldwide, limited license
to:
- Display
- Store
- Process for search and discovery
- Generate previews
- Maintain backups
- Perform security checks
Profylee does not sell or commercially license user content.
4. COPYRIGHT OBLIGATIONS
Users must ensure that:
- They own or legally control the content they upload
- The content does not infringe third-party IP rights
- No unlicensed images, stock media, fonts, or music are used
- AI-generated content is not based on copyrighted datasets illegally
Prohibited content includes:
- Stolen or plagiarized assets
- Unlicensed stock images
- Copied code
- Third-party designs or illustrations
5. TRADEMARK USAGE RULES
Users may not:
- Use third-party trademarks without authorization
- Falsely claim affiliation or certification
- Use Profylee logos for commercial purposes
- Display company logos in portfolios without permission
Misleading use such as:
“Official Partner”, “Certified by X” without proof
is strictly prohibited.
6. COPYRIGHT INFRINGEMENT NOTICE (DMCA-STYLE)
To file a copyright complaint, the rights holder must provide:
- Full legal name
- Description of the copyrighted work
- URL of the infringing content
- Statement of ownership
- Statement of good faith
- Contact information
- Digital signature

Profylee may remove or disable access to the content.
7. COUNTER-NOTICE PROCEDURE
Users whose content is removed may submit a counter-notice including:
- Proof of ownership
- Explanation of non-infringement
- Contact details
- Declaration of accuracy
Profylee will evaluate and may reinstate the content.
8. REPEAT INFRINGER POLICY
Multiple copyright violations may result in:
- Content removal
- Account suspension
- Permanent ban
This aligns with DMCA’s repeat infringer requirements.
9. PROFYLEE’S DISCRETIONARY AUTHORITY
Profylee reserves the right to:
- Remove content
- Restrict accounts
- Suspend or ban users
- Initiate legal action when necessary
10. POLICY UPDATES
This Policy may be updated periodically.
Material updates will be communicated to users.
